Employment Freedom - Get Your Green Card and be Free!


Non-immigrant temporary worker visas are the gateway into the United States for so many and could be the basis for applying for lawful permanent residency also known as a green card. Yet, while the non-immigrant temporary worker visa gets you into the United States, it is also your ball and chain until you obtain “employment freedom”.


Non-immigrant temporary worker visas may allow you to work within the United States yet not for any employer you choose, rather than just for the employer that has sponsored the non-immigrant temporary worker visa you currently hold. Most commonly, your non-immigrant temporary worker visa is valid for up to three years at a time.


Do these three years count as work stability? Are they enough stability, if at all, to allow you to make significant life choices? – For example, should you buy a car or lease one based on your non-immigrant temporary worker visa? Should you buy a house/apartment or rent? Which financial commitments can you allow yourself based on a non-immigrant temporary worker visa and which can you not?

These questions can be of troubling nature, since a non-immigrant temporary worker visa is only valid for as long as the circumstances that caused the visa to be approved continue to be true. Once these circumstances are no longer true, and the requirements for the visa are no longer met, it is the duty of the visa holder and the visa sponsor to inform USCIS (and by that the United States government) of the change in circumstances.


It is however within the realm of possibility that your visa sponsor knows this, and thus will allow itself to threaten you more (if at all), take you for granted, promote you less, offer you a lesser salary, etc. This is not necessarily the case though, just a theoretical possibility. Non-immigrant temporary worker visas are not without their fair share of possible psychological stress, as your work can be terminated at any point of time, causing the visa to be invalid.


A visa becoming invalid could bear unthinkable implications to the visa holder, their family, and beyond. A visa is not employment freedom, but the first step of the journey towards employment freedom within the United States. It is an opportunity to learn the American Way, the American system, American culture, gain experience, gain confidence, gain references from American employers. Your first visa is a first step, one of many that may come, towards employment freedom.

It means that the ball and chain that the non-immigrant temporary worker visa can act as, has no longer hold of you. Any so called “games” on behalf of your current or future employer may lead you to seek employment elsewhere, and in some cases, that is bad news for the employer, if not devastating!
