Applying for a Green Card Through Employment


To have your green card application approved, you must meet the eligibility criteria for at least one of the eight green card categories approved by the United States and supervised by USCIS. With the professional legal help of a U.S. immigration attorney, you should analyze your chances for each category, and file accordingly. The eight eligibility categories for green card status are:

1. Green card through family

2. Green card through employment

3. Green card as a “Special Immigrant”

4. Green card through refugee or asylee status

5. Green card for human trafficking and crime victims

6. Green card for victims of abuse

7. Green card through other categories

8. Green card through registry

Applying for a green card through employment you must prove to be a necessity for the American workforce. This means that an American employer and/or business must prove to USCIS that you meet its criteria to be essential to its function. Thus, you need to meet one of the following criteria:

  • You have extraordinary ability in the sciences, arts, education, business, or athletics, or

  • You are an outstanding professor or researcher, or

  • You are a multinational manager or executive who meets certain criteria

  • You are a second preference immigrant worker, meaning you:

    • You are a member of a profession that requires an advanced degree, or

    • You have exceptional ability in the sciences, arts, or business, or

    • You are seeking a national interest waiver

  • You are a third preference immigrant worker, meaning you are:

    • You are a skilled worker (meaning your job requires a minimum of 2 years training or work experience), or

    • You are a professional (meaning your job requires at least a U.S. bachelor's degree or a foreign equivalent and you are a member of the profession), or

    • You are an unskilled worker (meaning you will perform unskilled labor requiring less than 2 years training or experience)

  • You are a physician who agrees to work full-time in clinical practice in a designated underserved area for a set period of time and also meet other eligibility requirements

  • You are an “Immigrant Investor” that has invested or are actively in the process of investing at least $1,050,000 (or $800,000 in a targeted employment area or infrastructure project) in a new commercial enterprise in the U.S. which will create full-time positions for at least 10 qualifying employees
