Processes for Cubans, Haitians, Nicaraguans, and Venezuelans to Enter the United States - Part I


The United States government may grant advance travel authorization to up to 30,000 non-citizens each month to seek entrance to the United States on a case-by-case basis under the processes for Cubans, Haitians, Nicaraguans, and Venezuelans. According to the new review process carried out by USCIS, half of all online requests to be a supporter and declarations of financial support are randomly selected randomly, regardless of filing date, from the entire pending workload to review (Forms I-134A).


USCIS will review the other half of the monthly total of Forms I-134A based on when the case was submitted under the first come-first served method, which prioritizes the earliest Forms I-134A submitted for review. This is intended to maintain a meaningful and equitable opportunity for all beneficiaries of a Form I-134A to move forward through the process and seek advance travel authorization to the United States.

This process is free for both the person requesting to be the supporter and the people being supported. Do not pay anyone regarding this process, and if you are asked to pay, contact USCIS at www.uscis.gov first to avoid any scams.


The United States’ Department of Homeland Security has established processes through which nationals of Cuba, Haiti, Nicaragua, and Venezuela, and their immediate family members, may request to come to the United States in a safe and orderly way. Qualified beneficiaries who are outside the United States and lack U.S. entry documents may be considered.


Such consideration is on a case-by-case basis, for advanced authorization to travel and a temporary period of entrance to the United States for up to two years for urgent humanitarian reasons or significant public benefit. To be approved, a person must meet the following:

  • Have a supporter in the United States

  • Must pass a security check and vetting process

  • Meet other eligibility criteria; and

  • Warrant a favorable exercise of discretion


Cubans, Haitians, Nicaraguans, and Venezuelans must have a person based in the United States that agrees to pay for their entire stay while they are in the United States. This person must apply to USCIS to become their supporter before they are approved entry into the United States. Each Cubans, Haitians, Nicaraguans, and Venezuelans that wish to be supported, including children, must have the supported file a Form I-134A for them separately, online.


USCIS representing the U.S. government, then reviews the supporter’s information provided in the Form I-134A to ensure that they can financially support the person’s entire stay in the United States. One person can be the supporter for multiple Cubans, Haitians, Nicaraguans, and Venezuelans, or multiple people based in the United States can support one Cuban, Haitian, Nicaraguan, or Venezuelan.


To be approved as a supporter to one or more Cubans, Haitians, Nicaraguans, and Venezuelans a person must meet the following criteria:

  • Hold lawful status in the United States

  • Be a parolee or beneficiary of deferred action or Deferred Enforced Departure (DED) who has passed security and background vetting and demonstrated sufficient financial resources to receive, maintain, and support the individual(s) whom they commit to supporting for the duration of their stay in the United States

Examples of individuals who meet the supporter requirement include:

  • U.S. citizens and nationals

  • Lawful permanent residents (green card holder)

  • Lawful temporary residents

  • Conditional permanent residents

  • Non-immigrants in lawful status (who maintain their non-immigrant visa and have not violated any of the terms or conditions of their non-immigrant visa)

  • Asylees

  • Refugees

  • Others with legal permission to enter the United States

  • Individuals granted Temporary Protected Status (TPS)

  • Beneficiaries of deferred action (including deferred action for childhood arrivals) or DED


Who may be granted entrance to the United States with the support of a United States based supporter?

  • A national of Cuba, Haiti, Nicaragua, or Venezuela

  • Their immediate family member of any nationality who is outside the United States and who may be considered for entrance to the United States under these processes

  • A spouse

  • Common-law partner

  • The unmarried child(ren) under the age of 21

  • A child is under 18; In such a case they must be traveling with a parent or legal guardian in order to use this process


Other points to consider include:

  • Possess an unexpired passport valid for international travel

  • Provide for their own commercial travel to an air U.S. Point of Entry (POE) and final U.S. destination – they must pay their way to the United States

  • Undergo and pass required national security and public safety vetting

  • Comply with all additional requirements, including vaccination requirements and other public health guidelines

  • Demonstrate that a grant of entrance to the United States is warranted based on significant public benefit or urgent humanitarian reasons, and that a favorable exercise of discretion is otherwise merited


An person is ineligible (not allowed) to be considered for entry into the United States) under these processes if that person is a dual national or permanent resident of, or holds refugee status in, another country, unless the Department of Homeland Security operates a similar entry into the United States process for the country’s nationals.
